NYAC applauds signing of HIV testing bills



Albany - Governor Paterson signed into law two bills that seek to lower the rate of HIV infection in New York State. One bill will streamline the HIV testing process, while making HIV testing a routine part of healthcare for all New Yorkers. Another bill would eliminate barriers for New Yorkers seeking to access needle exchange and syringe access programs. These programs have received broad support based on an understanding that they save lives by preventing disease transmission and promote public safety by encouraging safe disposal of used syringes.

Brittany R. Allen, Executive Director of NYAC, stated "The new HIV testing law will go a long way to get more New Yorkers tested for HIV, detect HIV infection earlier for those who are positive, get people into proper care, and lower the overall rate of HIV infection in this state."

Allen continued, "This new law will make HIV testing a routine part of every day healthcare for every New Yorker. In turn, it will significantly decrease the stigma associated with HIV/AIDS, while increasing the number of people tested each year. By simply offering the test, regardless of their perceived risk, we will see the standard of care improve across the state. Additionally we will identify the one in four New Yorkers living with HIV who are unaware of their status."

In addition, Governor Paterson signed into law a bill that would significantly decrease the number of HIV and Hepatitis C infections through injection drug use, by changing the New York state penal code and decriminalizing the possession of syringes, including those which contain drug residue. Allen commented, "Despite the fact that syringe exchange and access programs have been in place for nearly two decades in New York, local law enforcement has consistently blocked many injection drug users from accessing these programs and making participation difficult for those simply seeking proper HIV and Hepatitis C prevention."

Allen continued, "By clarifying the regulations for possession and educating law enforcement, people will gain greater access to scientifically-proven prevention initiatives without fear of harassment or incarceration. This measure brings the penal code into harmony with the true intent of existing syringe exchange & access laws."

Along with the signing of the Family Healthcare Decision Act earlier this session, the HIV testing bill and the syringe access bill have been major priorities for the New York AIDS Coalition over the past few years. NYAC is pleased that this legislative session has made such significant inroads to enhance HIV prevention throughout New York State.

NYAC applauds the efforts of Governor David Paterson, Health Commissioner Dr. Richard Daines, as well as State Senators Duane and Schneiderman and Assemblymembers Gottfried and Lentol for their incredible efforts to bring forward this important legislation.
